Procedures related to SMS/Texting and Privacy
Governing Law: North Carolina General Statute G.S. 125-19 (Confidentiality of Library User Records)
The McDowell County Public Library System follows North Carolina G.S. 125-19 to protect the confidentiality of library user information. This document explains how we apply that law to optional SMS (text message) communications.
Mobile opt in data will not be shared with third parties.
1. Information We Collect
If you choose to receive SMS notifications, we collect only:
- Your mobile phone number
- Your name (optional)
We do not collect or link SMS sign-ups to your library card number or borrowing history.
2. How SMS Notifications Are Used
SMS messages are used only for:
- Program or event reminders (for programs you sign up for or opt into)
- Service announcements, such as unexpected closures or changes in hours
We do not send circulation notices (holds, overdue items), promotional marketing, or any other type of messaging via SMS.
3. Confidentiality Under North Carolina Law
North Carolina G.S. 125-19 protects the confidentiality of all library user records, including:
- Personal identifying information
- Any record linking a patron to a service, request, or use of library resources
Under this law:
- Your phone number and related SMS information are confidential
- They will not be disclosed except as permitted by statute (e.g., with your consent or by court order)
The library does not sell, share, or release your mobile number for marketing or commercial purposes.
4. Third-Party Service Provider
For SMS messages related to programs and events, the library uses Mailchimp.
Mailchimp receives your phone number only if you opt in to SMS alerts.
Mailchimp is required to:
- Keep your information confidential
- Use your phone number solely to send the messages you opted in to receive
- Comply with privacy and security standards applicable to library communications
5. Message Frequency
If you opt in, you can expect:
- About one text message per month, and/or
- A reminder for a program or event you registered for
We make every effort to keep messages limited and relevant.
6. Opting Out
You may stop receiving SMS messages at any time by:
- Replying STOP to any library text message
- Using the opt-out options provided in the sign-up form
- Contacting the Library Director for assistance.
Once you opt out, you will not receive further SMS messages unless you re-enroll.
7. Carrier Fees
Standard message or data rates from your mobile carrier may apply.
8. Updates
If SMS practices change, updated information will be posted on the library’s website along with the date the update goes into effect.
